The rights of these agreements may depend on circumstances, for example. B of why the worker is withdrawing. For example, a worker may be entitled to dismissal if he or she is dismissed “for no reason,” but not if he voluntarily retires or is fired “for good reason.” Persons or entities that are pre-published (usually referred to as “declassified parts”) are often broadly defined and include not only the employer, but also its related businesses and predecessors, as well as its owners, directors, executives, employees and agents. “The applicant must be bound. If the parties end a full resolution dispute, no one should be released seriously and voluntarily by a company. This is particularly true when, as here, the agreement was reached in favour of the party trying to escape the consequences of its own behaviour. Even if the clause that excludes access to justice was in itself invalid and unenforceable, the applicant must nevertheless fail. The reason is that he entered into an enforceable agreement that ultimately resolved his dispute with his employer. As a general rule, employers propose partial (if not exclusive) separation agreements to obtain a release and waiver of the rights of the outgoing worker. It is therefore essential that an employer have appropriate language to ensure that the release is applicable. The wording of their reciprocal termination documents to make it clear that termination is not a termination. The employee then appealed the case and went to the Labour Court of Appeal (“LAC”).
In reviewing the validity of the agreement, the LAC found that one of our younger clients was lucky in this regard. Our client was a co-worker who was under considerable pressure from the employer to terminate her work through a mutual separation agreement. She was a dedicated employee and had no disciplinary proceedings pending or prior to her. However, the employer wanted her job to be terminated and fortunately, our client recognized all the signs before it was too late. She advised us, and we intervened immediately to ensure that all her rights were protected under the law.
